Introduction / Acceptance of Terms

Welcome to Civ Arch Design Studio. We are a professional architecture., Civil design & Construction practice based in India, offering services that span architectural design, civil engineering consulting, project planning, and a range of related design disciplines and Construction. These Terms and Conditions govern the relationship between Civ Arch Design Studio (referred to throughout as “we”, “us”, or “the Studio”) and any individual, company, or entity (referred to as “you”, “the client”, or “the user”) who accesses our website, makes an enquiry, or engages us for any of our professional services. By visiting our website at [www.civarchdesignstudio.in] or by entering into a project agreement with us, you accept these Terms in full. If you do not agree with any part of these Terms, please refrain from using our website or engaging our services. We reserve the right to update or modify these Terms at any time. Continued use of our services following any such changes will constitute your acceptance of the revised Terms.

Services Overview

Civ Arch Design Studio provides professional services in the following areas:

  • Architectural design and drafting for residential, commercial, and institutional projects
  • Civil engineering consulting and structural advisory
  • Site planning, master planning, and land use design
  • Project documentation, working drawings, and approval submissions
  • Interior layout planning and space optimisation
  • Construction supervision and periodic site visits (where contracted)
  • Any related design or consultancy services or Construction as agreed upon in writing.
  • Any Residential / Commercial Construction and Planning

The specific scope of services for each project will be defined in a separate project agreement, proposal, or engagement letter issued to the client prior to commencement. Nothing in these Terms creates an obligation to deliver services beyond what is expressly agreed in writing.

 

User Responsibilities

When engaging with our website or commissioning our services, you agree to:

  • Provide accurate, complete, and timely information relevant to your project
  • Communicate openly and respond promptly to our requests for approvals, clarifications, or documentation
  • Ensure that all permissions, rights, and regulatory approvals required for your project are obtained where applicable
  • Not use our website or any content from it for unlawful, misleading, or harmful purposes
  • Not reproduce, copy, distribute, or commercially exploit any design, drawing, or material produced by us without prior written consent
  • Keep project-related communications respectful and professional

We reserve the right to suspend or terminate services if a client’s conduct is found to be abusive, misleading, or in breach of these Terms.

Intellectual Property Rights

All designs, drawings, concept presentations, reports, specifications, documents, and any other creative or technical output produced by Civ Arch Design Studio remain our intellectual property unless explicitly transferred to the client through a written agreement.

Upon receipt of full and final payment for a project, we grant the client a licence to use the deliverables specifically for the purposes of constructing or implementing the agreed project at the specified site. This licence does not include the right to resell, sublicense, or use the designs for any other project or location without our written consent.

Preliminary concepts, sketches, mood boards, and exploratory work produced during the proposal or pre-agreement phase remain exclusively the property of Civ Arch Design Studio and may not be reproduced or used by the client in any form.

We retain the right to use images, photographs, and descriptions of completed projects in our portfolio, marketing materials, and social media — unless the client explicitly requests confidentiality in writing.

Payments and Fees

Professional fees for each project will be outlined in our project proposal or engagement letter. Fees may be structured as a fixed lump sum, a phased payment schedule, or on a time-and-cost basis, depending on the nature and complexity of the project. All fees and payment terms are to be confirmed in writing prior to project commencement. Verbal commitments or informal agreements will not be binding unless documented in a formal project agreement signed by both parties. 

Cancellation and Refund Policy

Client-Initiated Cancellation
A client may cancel a project by submitting a written cancellation request to us via email at support@civarchdesignstudio.in . The date on which we receive the written request will be treated as the effective cancellation date. Cancellation requests must include the project name, client name, and reason for cancellation. Verbal cancellations or informal messages through social media or messaging platforms will not be accepted as formal cancellations.

Advance Payment — Non-Refundable
Any advance or mobilisation fee paid at the start of a project is non-refundable. This payment covers the initial work involved in understanding the project brief, conducting site assessment or research, assembling the project team, and preparing for work commencement. This cost is incurred from the moment a project is initiated and cannot be recovered once spent.

Partial Refunds Based on Work Completed
If a cancellation is requested after the project has progressed beyond the initial stage, the refund (if any) will be calculated based on the percentage of work completed at the time of the cancellation request.

The exact work completed at the time of cancellation will be assessed by us in good faith and communicated to the client in writing within 7 business days of receiving the cancellation request.

Timeline for Requesting Cancellations
Cancellations can be raised at any point during the project lifecycle. However, the sooner a cancellation is requested, the more straightforward the settlement process will be. Once a design phase has been formally approved by the client (in writing or via email confirmation), the fees associated with that phase are considered earned and non-refundable regardless of subsequent cancellation.

Situations Where No Refund Will Be Provided
No refund of any amount will be provided in the following circumstances:

  • The project has been fully completed and deliverables have been handed over.
  • The client approved the designs and then decided not to proceed with construction.
  • Cancellation is requested after regulatory submissions have been made on the client’s behalf.
  • Delays or changes were initiated by the client and contributed to the need for cancellation.
  • The client failed to provide timely inputs, approvals, or documentation, causing project stagnation.
  • The project was suspended at the client’s request and then cancelled after a period of inactivity.

Studio’s Right to Cancel
Civ Arch Design Studio reserves the right to cancel or suspend a project under the following circumstances:

  • Non-payment of fees beyond the agreed timeline.
  • Client conduct that is abusive, unethical, or in violation of these Terms.
  • Discovery of misrepresentation or fraudulent information provided by the client.
  • Regulatory, legal, or ethical conflicts that make project continuation untenable
  • In cases where we initiate the cancellation due to non-payment or client fault, no refund will be issued, and all outstanding fees will remain payable. If we cancel due to our own operational reasons, we will refund any fees paid for work not yet completed, as assessed in good faith.

Refund Processing Time
Where a refund has been agreed upon and confirmed in writing by both parties, the amount will be processed within 15 to 30 business days from the date of written confirmation. Refunds will be made to the same bank account or payment method used for the original payment. We are not responsible for delays caused by banking processes or intermediaries.

Limitation of Liability

Civ Arch Design Studio’s liability in connection with any project or service is limited to the total fees paid by the client for that specific project. We will not be liable for any indirect, consequential, incidental, or special damages arising out of or in connection with our services, including but not limited to loss of revenue, loss of profits, or any third-party claims.

We will not be held responsible for:

  • Delays caused by the client, government authorities, third-party contractors, or events beyond our control.
  • Errors or changes in local building regulations, planning policies, or approval requirements that affect the project after our engagement
  • Decisions made by the client or their appointed contractors that deviate from our approved designs
  • Defects or failures arising from construction that does not follow our documented specifications.

Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable Indian law.

Project Terms — Timelines, Revisions & Cooperation

Timelines
Project timelines will be outlined in the project agreement and are estimated in good faith. Timelines are, however, subject to change based on the complexity of the brief, client response times, regulatory authority timelines, and any changes instructed by the client during the project. We will communicate any significant delays promptly.

Design Revisions
Each project phase typically includes a specified number of revision rounds, as detailed in the project agreement. Revisions beyond the agreed number may be billed at our standard hourly or per-revision rate. Revisions requested after a phase has been formally approved may be treated as a scope change and billed accordingly.

Client Cooperation
Timely and constructive client participation is essential for successful project delivery. Clients are expected to:

  • Review and respond to design submissions within 5 to 7 working days, unless an alternative timeline is agreed.
  • Provide all required site information, survey data, NOC documents, and authority permissions in a timely manner.
  • Appoint a single point of contact for project communications to avoid contradictory instructions.
  • Promptly notify us of any changes to the project brief, site conditions, or budget parameters.

Undue delays caused by the client may result in revised timelines, additional charges, or suspension of work. We will provide written notice before suspending any project.

Termination of Services

Either party may terminate the professional engagement by providing written notice to the other. The terms governing termination, outstanding payments, and handover of work in progress will be as follows:

  • All fees for work completed up to the termination date are payable by the client.
  • We will hand over all completed drawings, documents, and files for which payment has been received.
  • Unpaid fees will be recoverable through appropriate legal channels under Indian law..
  • Confidentiality obligations survive the termination of the engagement.

Termination does not absolve either party of obligations that arose prior to the termination date.
